Terms and Conditions


These are the terms and conditions that regulate bookings with Endless Summer Tours. By making a booking with us, you agree to these terms and condition.

We reserve the right to change, modify, add to or remove from portions or the whole of these terms and conditions from time to time. Changes to these terms and conditions will become effective upon such changes being posted to this Website. It is your obligation to periodically check these terms and conditions on the website for changes or updates. Your continued use of this website following the posting of changes or updates will be considered notice of your acceptance to abide by and be bound by these terms and conditions, including such changes or updates.



Endless Summer Tours CC (registration number: 2005/077782/23) is a tour operator in Kwazulu-Natal, South Africa that specializes in private tours as well as shared small group tours.

4.1 The Tour Fee is based on the itinerary and is calculated including accommodation, meals, transport and tour personnel.

4.2 The Tour Fee includes the following:

4.2.1 Accommodation

As specified on the itinerary based on two people sharing a twin-bedded room. The use of hotels mentioned or implied in the tours is subject to accommodation being available. During the height of the local holiday season it may not always be possible to accommodate you at nominated hotels. In this event our operator reserves the right to make use of equivalent alternative hotels. This will in no way affect the price of the tour.

Single Accommodation is at an additional cost.

4.2.2 Meals

As specified on the tour itinerary. Any special meal arrangements will be made on a request basis only and may be subject to additional cost. We do not guarantee special meal requests, nor do we assume any responsibility or liability if your special meal requirements are not fulfilled.

4.2.3 Transport

In air-conditioned luxury vehicles.

4.2.4 Tour Personnel

The services of an experienced registered tour guide and approved driver will be used for the tour.

4.3 The Tour Fee excludes the following:

4.3.1 Tips and gratuities

Tips and gratuities for the courier/driver, for hotel/restaurant employees and for anyone performing a personal service not specified on the itinerary are not included in the Tour Fee and are left to your own discretion.

4.3.2 Personal items

Bar bills and items such as cigarettes, telephone calls, laundry, curios, gifts and other extras are for your own account.

4.3.3 Air fares

Unless specifically stated as included in a particular itinerary or package, air fares will not be included in the Tour Fee.

4.3.4 Passport, visas, health and immigration requirements

It is your responsibility to ensure that all passport, visa, health and immigration requirements are attended to. Endless Summer Tours and our operators accept no responsibility if such documentation is not in order.

4.4 No allowance or refund will be made for meals, accommodation, excursions, etc. that you choose not to take.


To confirm your booking, a non-refundable Deposit equal to 50% of the Tour Fee is payable.

Upon payment of the Deposit, you will be deemed to have read, understood and agreed to the terms and conditions set out herein.


Your Tour Date is selected at the time of booking. We reserve the right to change your Tour Date in accordance with operating requirements or circumstances beyond our control. Should a change in your Tour Date be necessary, we will give you reasonable notice and offer a comparable alternative.



Your booking will be confirmed once your Deposit has been received and cleared in our bank account.

The full Tour Fee must be paid 7 days before your tour date (“Payment Date”).

If the full Tour Fee is not paid on or before the Payment Date, we reserve the right to cancel your booking.


8.1 Cancellations must be emailed to us and will be effective on the date reflected on the email, as based on South African standard time (GMT +2).

8.2 Depending on the cancellation period, cancellations may qualify for the following refunds:

  • Cancellation before Payment Date (i.e. before the full Tour Fee has been paid): No refund
  • Cancellation after Payment Date but 41 to 60 days before your tour date: 40%
  • Cancellation after Payment Date but 21 to 40 days before your tour date: 30%
  • Cancellation after Payment Date but 8 to 20 days before your tour date: 15%
  • Cancellation after Payment Date but 1 to 7 days before your tour date: 0%

9.1 We reserve the right to:

  • change any route and/or arrangements should conditions necessitate this and to offer substitutions of equal value.
  • reschedule or adjust any tours due to lack of demand or for any other reason
  • use vehicles as dictated by demand
  • refuse to accept or retain any person as a member of any tour at any time, without giving any reasons therefore.
  • refuse to carry any person whose conduct or behaviour is likely to disrupt the tour or offend or upset the other member(s) of the tour. In this event full cancellation charges apply and we will have no further liability to that person.

9.2 Our employees or agents may not vary our conditions and any such purported variation will be of no effect unless it has been signed by one of our directors.


Smoking is only permitted in designated smoking areas as per the South African anti-tabaco legislation.



11.1 We hold comprehensive passenger liability insurance, the details of which will be made available on request. The company and co-operating agents act only in the capacity of agents for the passengers in all matters and as such hold themselves free of responsibility for any delays, loss or damages from any cause whatsoever.

11.2 We will not be liable for loss, damage, delay, inconvenience, or direct or consequential loss, however caused, unless due to our employees’ negligence, in which case our liability is limited (except for death or personal injury) to a maximum of the refund of the Tour Fee. We do not own or manage the trains, ships, accommodation and restaurants used and we have no liability for loss or damage caused by the proprietors or operators thereof.

11.3 All tours are arranged subject to the conditions imposed by the hotel, lodge, restaurant or any other individuals concerned and upon the express condition that the company and their servants/agents shall not be responsible for any and shall be exempt from all liability in respect of any loss, damage, injury, delay or inconvenience to any person/personal items/luggage and whether the same shall arise from or be occasioned by the negligence of the company, their agents or any other person directly or indirectly in the employment of the company or otherwise under any circumstances whatsoever.

11.4 All tours, charters and hires, itineraries, travel arrangements, accommodation are subject to alteration or cancellation at any time without prior notice for any cause which in the absolute discretion of the company renders it desirable, reasonable or necessary to effect such alteration or cancellation and in particular but without prejudice to the generality of the foregoing in the event of the revision of arrangements or the imposition of conditions by restaurants, hotel or transport contractors. No liability of any kind shall fall upon the company in respect of any such alteration or cancellation.


Notwithstanding any other provisions in these terms and conditions, we will not be liable or pay compensation if contractual obligations to you are affected by Force Majeure. This means any unforeseen circumstances beyond our or our suppliers’ control that prevent us from fulfilling a contract, of which could not have been avoided even if all reasonable measures were taken. Examples include warfare and acts of terrorism (including threats of terrorism), civil strife, significant risks to human health such as the outbreak of serious disease, a pandemic called and confirmed by the WHO, natural or nuclear disaster, fire, chemical or biological disaster or unavoidable technical problems with transport and all similar events outside our or the supplier(s)  control.



We strongly recommend that you take out comprehensive insurance cover for cancellation, personal injury, death, medical expenses, repatriation expenses and evacuation expenses before your trip. We strongly recommend your insurance also covers cancellation, personal liability and loss of personal property. Please check that the insurance covers all the activities that you are going to be participating in. Some policies exclude certain adventure activities. This should be arranged at the time of payment of the Deposit and will, in certain circumstances, cover you against loss of deposit or cancellation fees from the date of confirmation of your booking, as shown in the insurance policy. We cannot be held responsible for your failure to take out appropriate insurance. You also agree to indemnify us against all third-party claims, actions, damages and remedies which may be brought against us in respect of your participation in the trip.


Malaria prophylaxis may need to be taken when visiting Northern Kwa Zulu Natal, Mozambique and the Kruger National Park. Consult your local doctor for advice for travel to South Africa. We accept no responsibility for your decision and that of your doctor on whether or not to use malaria prophylaxis and/or the type used.


We offer a quality guarantee. If our guests are not completely satisfied with the services rendered, they will be entitled to compensation. Which is a money-back payment to the equivalent of but not exceeding the price we charge for our services. As not all tours, safaris and packages are equal, this amount will be determined by Endless Summer Tours on each, individual basis. All monies paid over to third-party providers will not form part of the compensation, (it is strictly our service fee), these include but not limited to:

  • Fuel and tolls.
  • Accommodation.
  • Activity providers.
  • Reserve or park admission fees.
  • Supermarkets and other shops.
  • Rentals.
  • Guide fees.

The client is not entitled to compensation if the issue is beyond our control or directly related to short comings from a 3rd party provider. These include but are not limited to:

  • Failure on the part of the accommodation provider. Dirty rooms, malfunctions, staff issues and so forth.
  • Failure on the part of activity providers. Incompetent staff or guides, cancellations, double bookings and so forth.
  • Vehicle malfunctions.
  • Protest action or other of a similar nature.
  • All other staff issues in general, when the said staff member is not employed directly with Endless Summer Tours.

Endless Summer Tours will however assist the guest in getting compensation from the guilty 3rd party provider if applicable.


These terms and conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
